ALERT: On March 16, 2023, we announced our mail delivery process for receiving a Form I-94 with an ADIT stamp. Form I-829 petitioners whose petitions are still pending adjudication but whose Permanent Resident Card and extension notices have expired may be eligible to use that process.

ALERT: On Jan. 30, 2024, USCIS announced a final rule, published in the Federal Register, that adjusts the fees required for most immigration applications and petitions. The new fees will be effective April 1, 2024.

Applications and petitions postmarked on or after April 1, 2024, must include the new fees or USCIS will not accept them.

What to Know About Sending Us Your Form

The new filing fee is effective for filings postmarked April 1, 2024, and later. If you are filing an acceptable prior form edition on or after April 1, 2024, you must include the new filing fee.

ALERT: In January 2023, USCIS extended the validity of Permanent Resident Cards (also known as Green Cards) for petitioners who properly file Form I-751, Petition to Remove Conditions on Residence, or Form I-829, Petition by Investor to Remove Conditions on Permanent Resident Status for 48 months beyond the card’s expiration date. Alert: We will continue to adjudicate Form I-829, Petition by Investor to Remove Conditions on Permanent Resident Status. We will adjudicate Form I-829 petitions associated with Form I-526, Immigrant Petition by Alien Entrepreneur, filed before March 15, 2022, under the applicable eligibility requirements in place before the enactment of the EB-5 Reform and Integrity Act of 2022, Div. BB of the Consolidated Appropriations Act, 2022 (Pub. L. No. 117-103) (Sec. 101 and 102).

Use this form if you are a conditional permanent resident who obtained status through a qualifying investment and want to remove the conditions on your residence.

When to File

If we granted you or your dependents conditional permanent resident status on the basis of investment in a new commercial enterprise, you must file Form I-829 during the 90-day period immediately before your conditional residence expires. The expiration date on your Green Card is also the date of your second anniversary as a conditional permanent resident.

Visit our When to File Your Petition to Remove Conditions, page to determine the first day of your 90-day filing window. If you file your petition before that date, we may reject it.

If you do not apply to remove the conditions within the 90-day period , we will terminate your conditional permanent resident status and you will become removable from the United States. However, if your failure to file within that 90-day period was for good cause and due to extenuating circumstances, you may file your petition late with a written explanation and request that USCIS, in its discretion, excuse your late filing.

Filing Fee
$3,750.

A biometric services fee of $85 is also required for the petitioners, as well as any current spouse, former conditional permanent resident spouse, or conditional permanent resident children between 14 and 79 years of age who are included on the petition. That means you must submit a separate biometric services fee of $85 for each conditional permanent resident who is applying with you to remove the conditions on their permanent resident status. See the detailed fee table below.

You can pay the fee with a money order, personal check, cashier’s check, or pay by credit card using Form G-1450, Authorization for Credit Card Transactions. If you pay by check, you must make your check payable to the U.S. Department of Homeland Security.

When you send a payment, you agree to pay for a government service. Filing and biometric services fees are final and non-refundable, regardless of any action we take on your application, petition, or request, or if you withdraw your request. Use our Fee Calculator to help determine your fee.

Pay each filing fee separately. We are transitioning to electronically processing immigration benefit requests, which requires us to use multiple systems to process your package. We may reject your entire package if you submit a single, combined payment for multiple forms.
